Constitutionality form of government, power-sharing under BBL, must be studied — Pimentel
MANILA, Philippines — Lawmakers must carefully study some of the provisions of the proposed Bangsamoro Basic Law (BBL).
As one of the resource persons in Tuesday’s Senate deliberation on the proposed Bangsamoro Basic Law, former Senate President Aquilino Pimentel Jr. said that there are provisions in the said proposed bill that might be declared as unconstitutional.
Such is the form of government of the Bangsamoro and the supposed power-sharing with the national government.
“To allow a part of the country to be governed under a parliamentary form of government when the Constitution itself proclaims that the whole country has adopted the presidential form of government,” said Pimentel.
However, the Office of the Presidential Adviser on the Peace Process said that some of these provisions had already been addressed and revised in the version of the Bangsamoro Transition Commission (BTC).
The BTC said that a constitutional body should be created to carefully scrutinize each provision of the BBL.
“Well there are provisions in the BBL which may appear to be unconstitutional but they should not outright deleted but it should be a point of concern,” said Sultan Firdausi Abbas, a member of the BTC.
The government is resolute in its stance that the BBL is necessary to end the armed conflict in Mindanao.
“Failure to pass the BBL would result in the exact opposite, a grimmer picture that is already taking form because of continuous delay and the Moro people are beginning to lose faith in the peace process,” said National Security Adviser Hermogenes Esperon Jr.
Meanwhile, Senate subcommittee on BBL chairman Juan Miguel Zubiri said that they are going to make some amendments to ensure that the BBL will not go against the Constitution.
“Maybe instead of calling it parliament maybe we can call it assembly. Maybe instead of calling a minister, maybe you can call him executive director,” said Zubiri. —Nel Maribojoc | UNTV News & Rescue
