SC junks disbarment complaint against Ombudsman Morales

All justices of the Supreme Court (SC) on Tuesday, agreed to junk the complaint filed by former Manila city councilor, Greco Belgica last Friday against Ombudsman Conchita Carpio Morales.

“The court unanimously dismissed the complaint filed by Mr. Belgica for lack of merit,” said SC spokesperson Atty. Theodore Te.

Belgica claimed Morales violated the lawyer’s oath when she dismissed the graft charges arising from the disbursement acceleration program against former president Benigno Aquino III.

He also claimed that the Ombudsman lacks integrity and is biased.

The high court, however, said Morales could not be disbarred while in office since being a lawyer is a requirement for her position.

“A public officer who under the Constitution is required to be a member of the bar as a qualification for the office held by him/her and who may be removed from office only by impeachment, cannot be charged with disbarment during the incumbency of the public officer,” Atty. Theodore Te said,

The court also rejected Belgica’s reasoning that Morales may be charged with disbarment but the penalty may only be imposed after she steps down next year. – Roderic Mendoza | UNTV News & Rescue
